Google has shown that they are ready to settle a class action lawsuit filed in 2020. The lawsuit was over Chrome's Incognito Mode and how Google was continuing to track, collect, and identify user's moves in spite of stating the opposite.
The lawsuit was originally filed by William Byatt, Chasm Brown, and Ms Nguyen who believe they were in breach of wiretap laws. They also stated sites using tools such as Google Analytics and Ad Manager were still able to collect data from said browsers. The data consists of web page content, device data, and IP addresses.
Also being accused of grouping private data with user profiles, first Google aimed at getting the case dismissed.
Google stated that incognito on startup states how your activity might still be visible to sites you visit. The judge did not view it the same way, leaving their dismissal to be rejected. The judge stated users were not informed of continued data collection.
Notice filed on Tuesday states that Google and the plaintiffs have reached an agreement on their own terms which will result in a litigation dismissal. The agreement will be showcased in January and hopefully approved in February.
